RenterUp allows landlords and property managers the ability to set up their properties and their respective tenants for the purposes of collecting online rental payments, online notification management, and online maintenance request communications.

Our Relationship with You.
RenterUp is a Payment Service Provider. RenterUp helps landlords, owners, and property managers accept payments from tenants of rental units. RenterUp is an independent contractor for all purposes, and is not your agent or trustee. RenterUp does not have control of, or liability for, the products or services that are paid for via the RenterUp application. We do not guarantee the identity of any User or ensure that a tenant or a landlord will complete a transaction.
Privacy of Others; Marketing. If you receive Information about another User through the RenterUp application, you must keep the Information confidential and only use it in connection with the RenterUp application. You may not disclose or distribute a User’s Information to a third party or use the Information for marketing purposes unless you receive the User’s express consent to do so.
Intellectual Property. “RenterUp.com”, “RenterUp”, and all logos related to the RenterUp application are either trademarks or registered trademarks of RenterUp Ventures, LLC. You may not copy, imitate or use them without RenterUp’s prior written consent. In addition, all page headers, custom graphics, button icons, and scripts are service marks, trademarks, and/or trade dress of RenterUp. You may not copy, imitate, or use them without our prior written consent. All right, title, and interest in and to the RenterUp website, any content thereon, RenterUp Services, the technology related to RenterUp Services, and any and all technology and any content created or derived from any of the foregoing is the exclusive property of RenterUp and its licensors.
Assignment. You may not transfer or assign any rights or obligations you have under this Agreement without RenterUp’s prior written consent. RenterUp reserves the right to transfer or assign this Agreement or any right or obligation under this Agreement at any time.
Password Security and Keeping Your Email and Address Current. You are responsible for maintaining adequate security and control of any and all IDs, passwords, personal identification numbers (PINs), or any other codes that you use to access RenterUp. You are responsible for keeping your mailing address and email address up to date in your Account Profile.
Notices to You. You agree that RenterUp may provide you Communications about your Account and the RenterUp Services electronically. Any electronic Communications will be considered to be received by you within 24 hours after the time we post it to our website or email it to you.
Notices to RenterUp. Notices to RenterUp should be sent by postal mail to: RenterUp Ventures, LLC., Attention: Legal, 2870 Peachtree Road NW, #226, Atlanta, GA 30305.
Calls to You; Mobile Telephone Numbers. By providing RenterUp a telephone number (including a mobile telephone number), you agree to receive autodialed and prerecorded message calls at that number. The ways in which you provide us a telephone number include, but are not limited to, providing a telephone number at Account opening, adding a telephone number to your Account at a later time, providing it to one of our employees, or by contacting us from that phone number. If a telephone number provided to us is a mobile telephone number, you consent to receive SMS or text messages at that number. We will not share your phone number with non-affiliated third parties for their purposes without your consent, but may share your phone numbers with our our service providers, such as ID verification services, payment gateways, billing and collections companies, who may contact you using autodialed or prerecorded message calls or text messages. Standard telephone minute and text charges may apply if we contact you.
Eligibility. To be eligible to use the Renterup, you must be at least 18 years old and a resident of the United States. While RenterUp can be accessed Globally, RenterUp can only support bank accounts based in the United States.
Identity Authentication. You authorize RenterUp, directly or through third parties, to make any inquiries we consider necessary to validate your identity. This may include asking you for further information, requiring you to provide your date of birth, a taxpayer identification number, and other information that will allow us to reasonably identify you, requiring you to take steps to confirm ownership of your email address or financial instruments, ordering a credit report, or verifying your Information against third party databases or through other sources. We may also ask to see your driver’s license or other identifying documents at any time. RenterUp reserves the right to close, suspend, or limit access to your RenterUp Account in the event we are unable to obtain or verify this Information.
Sending Limits. We may, at our discretion, impose limits on the amount of money you can send through Renterup, including money you send for rent.
Preferred Payment Method. Currently within RenterUp, electronic ACH payments (aka, eCheck) is the only method of rental payments.
Insufficient Funds. If a tenant attempts to pay rent but there are insufficient funds to support the transaction, the fund will appear as failed and the landlord will not receive the funds. RenterUp will automatically initiate a non-refundable $15 NSF (non-sufficient funds) debit from the tenant’s account, payable to RenterUp. You agree to allow RenterUp to recover any amounts due to RenterUp by debiting your bank account. If there are insufficient funds in your bank account to cover your liability, you agree to reimburse RenterUp through other means.
Processing Payments. When you send a payment to a landlord, the payment will be marked as pending until the payment has cleared. Payments may be pulled from your account the day after you submit the payment, but typically take 4-5 business days to clear into your landlord’s account.
Accuracy of Information. You are responsible for confirming the accuracy of the information you provide about each payment you send, including the amount of the transaction.
Receiving Payments. When a tenant submits payment to you, the payment will be marked as pending until the payment has cleared. Payments may be pulled from the tenant’s account the day after payments are submitted, however, it typically takes 4-5 business days to clear into your account.
Payment Review. Payment Review is a process by which RenterUp reviews certain potentially high-risk transactions. If a payment is subject to Payment Review, RenterUp will place a hold on the payment and provide notice to the Landlord. RenterUp will conduct a review and either clear or cancel the payment. RenterUp will provide notices to you by email and within your Account.
Automated Fraud Alerts. RenterUp deploys several fraud detection mechanisms, which may be flagged at any time. If RenterUp is notified by any of its third party fraud detection providers or if RenterUp detects any suspicious activity, RenterUp will place a hold on any payments and provide notice to the tenants and/or landlords.
Risk of Reversals, Chargebacks, and Claims. When you receive a payment, you are liable to RenterUp for the full amount of the payment sent to you plus a non-refundable $15 Fee if the payment is later invalidated for any reason. This means that, in addition to any other liability, you will be responsible for the amount of the payment sent by the sender, plus the applicable $15 Fee if you lose a Claim or a Chargeback or if there is a Reversal of the payment. You agree to allow RenterUp to recover any amounts due to RenterUp by debiting your bank account. If there are insufficient funds in your bank account to cover your liability, you agree to reimburse RenterUp through other means. If a sender of a payment files a Reversal, the banking entity, not Renterup, will determine who wins the Reversal.
Taxes. It is your responsibility to determine what, if any, taxes apply to the payments you make or receive, and it is your responsibility to collect, report and remit the correct tax to the appropriate tax authority. RenterUp is not responsible for determining whether taxes apply to your transaction, or for collecting, reporting or remitting any taxes arising from any transaction. You acknowledge that RenterUp will report to the Internal Revenue Service the total amount of payments for goods and services you receive each calendar year into all the Accounts you own if you receive into these Accounts (i) more than $20,000 in payments for goods or services and (ii) receive more than 200 payments for goods or services in the same calendar year.
Closing Your Account.
How to Close Your Account. You may close your Account at any time by emailing email@example.com. If you have a pending payment, we will not close your Account until that payment has cleared, but we may limit your ability to make or receive additional transactions using your Account.
Limitations on Closing Your Account. You may not close your Account to evade an investigation. If you attempt to close your Account while we are conducting an investigation, we may hold your Account open for up to 180 Days to protect RenterUp, its affiliates, or a third party against the risk of Reversals, Chargebacks, Claims, fees, fines, penalties and other liability. You will remain liable for all obligations related to your Account even after the Account is closed.
Dormant Accounts. If you do not log in to your Account for two or more years, Renterup may close your Account. Where required, RenterUp will send you a notice prior to closing your Account.
Restricted Activities. In connection with your use of our website, your Account, the RenterUp application, or in the course of your interactions with RenterUp, other Users, or third parties, you will not:
- Breach this Agreement or any other agreement or policy that you have agreed to with RenterUp;
- Violate any law, statute, ordinance, or regulation (for example, those governing financial services, consumer protections, unfair competition, anti-discrimination or false advertising);
- Infringe Renterup’s or any third party’s copyright, patent, trademark, trade secret or other intellectual property rights, or rights of publicity or privacy;
- Sell counterfeit goods;
- Act in a manner that is defamatory, trade libelous, threatening or harassing;
- Provide false, inaccurate or misleading information;
- Send or receive what we reasonably believe to be potentially fraudulent funds;
- Refuse to cooperate in an investigation or provide confirmation of your identity or any Information you provide to us;
- Attempt to double dip during the course of a dispute by receiving or attempting to receive funds from both RenterUp and the tenant, bank or credit card issuer for the same transaction;
- Control an Account that is linked to another Account that has engaged in any of these Restricted Activities;
- Conduct your business or use the RenterUp in a manner that results in or may result in complaints, Disputes, Claims, Reversals, Chargebacks, fees, fines, penalties or other liability to RenterUp, other Users, third parties or you;
- Take any action that imposes an unreasonable or disproportionately large load on our infrastructure; facilitate any viruses, Trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or Information; use an anonymizing proxy; use any robot, spider, other automatic device, or manual process to monitor or copy our website without our prior written permission; or use any device, software or routine to bypass our robot exclusion headers, or interfere or attempt to interfere with our website or the RenterUp application;
- Take any action that may cause us to lose any of the services from our Internet service providers, payment processors, or other suppliers;
- Circumvent any RenterUp policy or determinations about your Account such as temporary or indefinite suspensions or other Account holds, limitations or restrictions, including, but not limited to, engaging in the following actions: creating new or additional RenterUp Accounts using information that is not your own (e.g. name, address, email address, etc.); or using someone else’s RenterUp Account;
- Harass our employees, agents, or other users.
Users agree to indemnify and hold RenterUp harmless from and against any and all third party claims, demands, actions, losses, liabilities, costs and expenses (including reasonable attorney’s fees) arising out of or resulting from any user’s (or its affiliates) actions with regard to the Sites.
RenterUp shall be excused from delay in the performance of any obligations hereunder when such delay is the result of or attributable to acts of God, governmental authority, manufacturers delays or any other cause beyond their reasonable control.
